Many years ago, there were advertisements on the roadside from scammers offering large sums of money for children, labeled as "Hong Kong rich women". However, I never expected that in 2022, there would actually be people who would fake marriages to obtain Hong Kong identity.
Hong Kong initially introduced this immigration policy with good intentions, allowing couples separated between the mainland and Hong Kong to reunite.
Once one party in the mainland accumulates enough points, they can apply for a one-way permit to legally enter Hong Kong, and after 7 years, they are eligible to apply for permanent resident status in Hong Kong, enjoying the same benefits as locals.
Compared to the Hong Kong Quality Migrant Admission Scheme and the Hong Kong Talent Scheme, this method can bypass relatively complex and strict immigration policies, but it also provides opportunities for opportunists.
Marriage is a private relationship that is difficult to define, so some people use fake marriages to help those who do not meet the application criteria obtain Hong Kong identity, charging high fees.
This phenomenon still persists despite being banned, with similar methods of committing the crime. Both parties will draft a fake marriage agreement and prepare local and mainland residences. Hong Kong has always been actively cracking down on and punishing such behaviors. According to relevant regulations, mainland individuals suspected of "fake marriage" will face a fine of up to HKD 150,000 and a prison sentence of 14 years once confirmed.
For those who conspire to commit fraud, they can be sentenced to a maximum of 14 years in prison according to the relevant provisions of the Crimes Ordinance and the Criminal Jurisdiction Ordinance upon conviction.
So everyone should choose a reasonable and legal way to obtain Hong Kong identity!
